Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and DU Primehealth Insurances LLC ("Company," "we," "us," or "our"), concerning your access to and use of the duprimehealthinsurances.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
You agree that by accessing the Site and/or using our services, you have read, understood, and agree to be bound by all of these Terms and Conditions. DU Primehealth Insurances LLC is a direct business lender providing working capital loans, equipment financing, and revenue-based financing solutions to qualified businesses. All funding decisions are made in-house with no third-party intermediaries.
Funding Application Process
By submitting a funding application through our website or other communication channels, you authorize us to review your business financial information, verify your identity and business credentials, and conduct credit and background checks as necessary to evaluate your application.
No Guarantee of Approval
Submission of a funding application does not guarantee approval. All applications are subject to dual-review processes and approval criteria established by DU Primehealth Insurances LLC at our sole discretion.
Intellectual Property Rights
Unless otherwise indicated, the Site and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
User Representations
By using the Site and our services, you represent and warrant that:

SMS Program Description
By providing your mobile phone number and expressly consenting via our contact form or other opt-in mechanism, you agree to receive recurring marketing and promotional SMS/MMS messages from DU Primehealth Insurances LLC, including offers, updates, and information about our financial products and services, sent using an automated telephone dialing system (ATDS).
Message Frequency
Message frequency varies. You may receive up to 4 messages per month, depending on your account activity, funding status, and promotional campaigns. We reserve the right to adjust message frequency based on operational needs.
Message and Data Rates
Message and data rates may apply. Standard messaging rates from your mobile carrier will apply to all SMS messages sent and received. Please consult your mobile service carrier's pricing plan to determine the applicable charges for receiving and sending text messages.
How to Opt Out
You may opt out of receiving SMS messages at any time by replying STOP to any text message you receive from us. After you send the STOP message, we will send you a confirmation text message to confirm that you have been unsubscribed. Following this confirmation, you will no longer receive SMS messages from us unless you re-opt-in by providing consent again.

Indemnification

Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms and Conditions will be brought exclusively in the federal or state courts located in Cumberland County, North Carolina, and the parties hereby consent to the personal jurisdiction and venue of such courts.
Dispute Resolution
Any legal action of whatever nature brought by either you or us (collectively, the "Parties" and individually, a "Party") shall be commenced or prosecuted in the state and federal courts located in Cumberland County, North Carolina, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such courts.
Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of our services without notice at any time.
